Two of the New York’s most popular tanning salons are accused for deliberately downplaying the risks of indoor tanning and misleading the public by claiming that it has benefits that actually do not exists.
Eric Schneiderman sued the two companies Total Tan Inc and Portofino Spas LLC.
On Thursday, the Attorney General has filed a law suit against the companies for violating state law by advertising false testimonials, claims and not sharing important information necessary to allow public to think over the benefits and hazards of the treatment and to make a balanced decision.
The suit has lashed at the advertising campaign of the company where it has given the impression that indoor tanning is much safer than outdoor natural tanning.
Schneiderman said, “Make no mistake about it: There is nothing safe about indoor tanning. The use of ultraviolet devices increases exposure to cancer-causing radiation and puts millions of Americans in serious danger -— young adults, in particular. … Advertising and marketing cannot be used as a tool to confuse and endanger New York consumers.”
The company Total Tan has hit back at the lawsuit of the Attorney General claiming that the services it provides fall 100 percent within state and federal laws which also includes their advertising campaign.
The company response read, “The attorney general’s claim that Total Tan produced misleading advertising is not true. We are a small, upstate, family-owned business that refuses to be intimidated by Mr. Schneiderman, who is trying to impose his own view of the world on our industry and the citizens of upstate New York.”
Schneiderman has sent notices to both Beach Bum Tanning and Planet Fitness that the lawsuit will be filed against them in near future.
McCall Gosselin, representative of Planet Fitness said, “Since being notified of these alleged violations, Planet Fitness corporate headquarters has worked closely with all franchisees to emphasize the importance of following all applicable state laws.”
“Additionally, over the last year, Planet Fitness has been working with the Office of the Attorney General with regard to this matter, and we look forward to the opportunity to continue to work with their office in mutual good faith to reach a resolution.”
There is no response from Beach Bum Tanning.
